Terms of Service

1. Agreement to Terms

By accessing or using CastClip ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

CastClip is a podcast content generation platform that transforms audio content into written materials including show notes, social media posts, and descriptions. The Service includes audio transcription, AI-powered content generation, and content management features.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Subscription and Payments

Billing

Paid subscriptions are billed in advance on a monthly basis. You authorize us to charge your payment method for the applicable subscription fees.

Plan Limits

Each subscription tier includes a specific number of episodes per month. Unused episodes do not roll over to the next billing period.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

Price Changes

We reserve the right to modify pricing with 30 days' notice. Continued use after price changes constitutes acceptance of the new pricing.

5. Acceptable Use

You agree NOT to use the Service to:

  • Upload content you do not have rights to use
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malware or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for illegal or fraudulent purposes
  • Resell or redistribute the Service without authorization

6. Content Ownership

Your Content

You retain ownership of all audio files and content you upload to CastClip. By uploading content, you grant us a limited license to process, store, and generate derivative content as part of the Service.

Generated Content

Content generated by CastClip (show notes, social posts, etc.) is owned by you. You may use this content for any lawful purpose without attribution to CastClip.

Our Content

The Service, including its design, features, and underlying technology, is owned by CastClip and protected by intellectual property laws.

7. Third-Party Services

The Service integrates with third-party providers for transcription, content generation, and payment processing. Your use of these integrations is subject to the respective third-party terms of service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any loss resulting from service interruptions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTCLIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Indemnification

You agree to indemnify and hold harmless CastClip and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
